๓.๓.๖ กฎหมายประเทศสวีเดน

รัฐธรรมนูญสวีเดน วางหลักเกี่ยวกับความเท่าเทียมกันและการไม่เลือกปฏิบัติไว้ ดังนี้
มาตรา ๑๕ วางหลักว่า “กฎหมายหรือบทบัญญัติใด ๆ จะต้องไม่ก่อให้เกิดการปฏิบัติต่อพลเมือง

ในลักษณะกีดกันเนื่องจากการที่พลเมืองคนนั้นเป็นสมาชิกชนกลุ่มน้อย ด้วยเหตุแห่งเชื้อชาติ สีผิว ชาติก�าเนิด”
มาตรา ๑๖ วางหลักว่า “กฎหมายหรือบทบัญญัติใด ๆ จะต้องไม่ก่อให้เกิดการปฏิบัติต่อพลเมือง
ในลักษณะกีดกันด้วยเหตุแห่งเพศ เว้นแต่บทบัญญัติดังกล่าวเป็นส่วนหนึ่งของมาตรการส่งเสริมความเท่าเทียมกัน

นอกจากรัฐธรรมนูญแล้ว สวีเดนยังมีกฎหมายเฉพาะเกี่ยวกับการห้ามเลือกปฏิบัติ ทั้งนี้ เดิม

กฎหมายเกี่ยวกับความเท่าเทียมกันและการห้ามเลือกปฏิบัติของประเทศสวีเดน ถูกบัญญัติรับรองไว้ในลักษณะ
กระจัดกระจายตามกฎหมายเฉพาะหลายฉบับ อาทิ
• กฎหมายโอกาสที่เท่าเทียมกัน (The Equal Opportunities Act (Swedish Code of Statutes

1991:433)
• กฎหมายเกี่ยวกับมาตรการต่อต้านการเลือกปฏิบัติในชีวิตการท�างานด้วยเหตุแห่งเชื้อชาติ ศาสนา
หรือความเชื่อทางศาสนา (The Act on Measures against Discrimination in Working Life on Grounds of

Ethnic Origin, Religion or Other Religious Faith (Swedish Code of Statutes 1999:130)
• กฎหมายห้ามการเลือกปฏิบัติในชีวิตการท�างานด้วยเหตุแห่งความพิการ (The Prohibition of
Discrimination in Working Life on Grounds of Disability Act (Swedish Code of Statutes 1999:132))

• กฎหมายห้ามการเลือกปฏิบัติในชีวิตการท�างานด้วยเหตุแห่งรสนิยมทางเพศ (The Prohibition of
Discrimination in Working Life on Grounds of Sexual Orientation Act (Swedish Code of Statutes

• กฎหมายการปฏิบัติที่เท่าเทียมกันส�าหรับนักศึกษาในมหาวิทยาลัย (The Equal Treatment of
Students at Universities Act (Swedish Code of Statutes 2001:1286))

• กฎหมายห้ามเลือกปฏิบัติ (The Prohibition of Discrimination Act (Swedish Code of
Statutes 2003:307))

From the Constitution of Kingdom of Sweden, Chapter 2 Fundamental Rights and Freedoms, Article
15 states that “No act of law or other provision may imply the unfavourable treatment of a citizen because he
belongs to a minority group by reason of race, colour, or ethnic origin.”

a citizen on grounds of gender, unless the provision forms part of efforts to promote equality between men and
women or relates to compulsory military service or other analogous official duties.”
