Human Rights principles and criminal punishment

Abstract
The criminal sanction is one of the important state’s measures to maintain public
order. Due to state measures applied to individual, criminal sanction has to conform to
the Human Rights principles. In virtue of the principle of proportionality, the state has
to apply criminal sanction proportionally to the offence. Furthermore, in light of the
principle of rehabilitation, the state should consider the rehabilitation and resocialization
of the offender as an objective of punishment.
