ational Human Rights Commission of Thailand (NHRC) have received many
complaints about state violations against individual and community rights on
issues relating to land and forest utilization caused by the implementation of laws and policies
that do not take into account the current specific circumstances and all possible impacts, which
has created negative consequences on the perceived equality and fairness across fragile group
in the society.
By reviewing case studies in each perspective of land use and legal and economic
mechanisms regarding to land management, this study found that human rights violation
resulted from using inappropriate tools in land and forest law and policies. For instance, lack of
tool to distribute land holdings and ensure tenure security, lack of tool to monitoring land
utilization by public agency, lack of tool to create well-round land database, derogation of
the tools that prevent negative consequences on land, and misuse of criminal law led to
conflict and violence.
Therefore, delivering appropriate tools in managing land in laws and policies will ensure
the rights of individual and communities in utilizing the land, protecting human rights and
promoting sustainable natural resources and environmental managements on the basis of
human rights and the United Nations Sustainable Development Goals which focus on a
people-centric approach.
