Human Rights and Protection of Liberty
to engage in an occupation
Associate Professor Dr. Suphasit Taweejamsup
Abstract
The conceptual framework of “human rights” emphasizes actions supporting
human beings for respect of human dignity, rights, and liberties equally. Liberty to
engage in an occupation is an integral part of labour rights which can be considered
in a wide variety of contexts for each country. For establishing appropriate
mechanisms to protect liberty to engage in an occupation, it is necessary to
preliminarily understand the constituents and the exclusion conditions of the
accepted liberty to engage in an occupation in the State. However, for using of
human rights principles as a tool to protect the liberty to engage in an occupation,
there is no stereotype that oblige the states to respect of human rights but the
states must take actions in response to the three mechanisms of human rights
recognition: respect, prevention and enrichment of the content of human rights.
Consequently, the enforcement of human rights protecting the liberty to engage
in an occupation is seeking an appropriate means which is under the three
mechanisms of human rights principles recognized by the states within the
framework of academic principles and practices.
