Abortion in cases of fatal foetal anomaly and
the right not to be tortured

Abstract
This article examines whether there is a violation of the absolute right not to be
tortured or treated in a cruel manner by prohibiting the women from having an abortion
in a fatal foetal anomaly case. The European Court of Human Rights’ and the UK
Supreme Court’s rulings are used as authorities to see the trend. From the study,
it is found out that it is not yet universally recognised that the right is violated by
the prohibition. The arguments in favour, however, are considerably convincing and
gaining acceptance increasingly. This paper suggests that Thai law adopts the position
and amend the Penal Code, section 305, to allow women to get an abortion for this cause.
