Abstract
A research project according to budget plans of the 2014 fiscal year on:
Guidelines of the public’s participation in defining the boundaries of the state’s
land. The research project has the following objectives (1) to study laws related to
land management and defining boundaries according to attached maps or other
related divisions responsible for land management (2) to study and propose ways
to solve problems regarding overlapping boundaries of reserve land with other state
lands that the state has allocated to the public, and (3) to study and propose ways
that the public could participate in defining boundarines of state’s land, including
ways to resolve conflicts between the state and the public to define boundaries
of state’s land.
This research study was a study of laws relating to land management that are
currently used in divisions directly handling the management of land as well as the
boundaries defined with attached maps or other related divisions, studied problems
and ways to solve problems of those divisions, and studied ways in solving problems
of overlapping boundaries of the reserve land and state lands that the state offers
to the public. In addition, studied on conflicts in the right of ownership land usage
in a case study, causes of problems and resolutions, including the participation
of the public. The areas of study were according to the complaints of public to
the National Human Rights Commission with which the key characteristics include:
the definition of boundaries such that state land overlap with residential areas in
many areas, the definition of boundaries such that state land overlap within the
same area of different divisions, and ecosystems as well as various ways of life of
the public in different communities of 7 selected provinces in Thailand including
Kanchanaburi, Ratchaburi, Nakhon Ratchasima, Sakon Nakhon, Lumpang, Surat Thani
and Pattalung. The analysis study showed the following results:
The analysis was on 9 issues including: (1) Participation of the public who do not
progress as the system of bureaucracy did not support vulnerabilities or obstacles in legal
measures including public and government agencies do not see its importance causing
misunderstandings and lack of actual participation. (2) Relationships with the participation,
information and decentralization have to be consolidated as a single issue because their
relationships are related and there should be a division responsible for such. (3) The
division responsible for defining land boundaries of the state has no sincerity in resolving
