Abstract of Chapter 6
Violation of Labor Rights in Informal Sector
In this chapter, the following substances were mentioned.
1. Overall situation of informal workers, particularly those under the classification of National
Socio-Economic Development Board
2. Problem environments and types of abuse.
2.1 Emphasis of home workers would be observed because this group reflected direct effect
with employment in formal sector and if there was no immediate protection for this group
of workers, those in formal sector would face more severe problems.
2.2 Coverage on principle and concept of International Labor Organization, particularly
principle of decent work, concept and main points of the ILO Convention No. 177 on
Home Worker.
3. Management and coordination with informal labor network of Sub-committee on Labor Rights
regarding the move to get law promulgation which divided into two parts:
3.1 Cooperation in pushing the Protection of Home Workers Development Promotion Act,
B.E…. in accordance with the informal workers network.
3.2 Cooperation in pushing for the expansion of social security to cover informal workers and
reference to the proposal of informal worker network on social security for informal
workers issue.
Study includes outstanding seminar and campaign activities
4. Policy-wise recommendations.
Some examples include raising struggling level on informal workers and unfair employment as
prior national agenda.
Adjustment of economic policy relating to health and safety to synchronize with internal and
external systems and speeding up ratification for ILO Convention No. 177 concerning home worker.
Abstract of Chapter 7
Violation of Labor Rights of Overseas Thai Workers.
Situation of labor right abuses against Thai workers who are working in other countries.
Study on the complaints under the responsibility of Sub-committee to Study and Examine Labor
Problems to Investigate Complaints and Sub-committee on Labor Rights since 2002 to September
30,2007 found that there were 11 complaint cases on labor right abuses against workers who worked in
other countries. Most complaints were made by poor workers from the Northeastern region.
Problems of labor right abuse among overseas Thai workers include many types, for examples:
1. Advanced payment was made and no trip to the country as expected.
2. Service charge was paid higher than the law.
3. After arriving the destination country, there was no job and was sent back.
4. After arriving the destination country, got a job, but not the position as specified in the contract.
5. Upon arrival, got a job of specified position, but the wage was lower than that of mentioning
in the contract.
6. Got a job of specified position and wage, but term of employment was shorter than what
was mentioned in the agreement, such as after working for three or six months the workers
were sent back home, some were not aware that they went there to replace their colleagues
who had just been sent back home, etc.
