Abstract of Chapter 1
Introduction
1. Background
Since the Office of the National Human Rights Commission was established in 2001, complaints
on labor right violation were also in the case and prompted the National Human Right Commission
(NHRC) to appoint a sub-committee to study and examine labor dispute between Gina Form Bra Co., Ltd.
and its workers in 2002. Later, complaint cases had been increasing significantly and a sub-committee for
‘study and examine on labor issues’ was appointed in order to promote, protect, and solve problems, as
well as to support NHRC execution on labor for better achievements and cover all tasks concerning
human rights on labor issues. Such power was given in accordance with NHRC Act, B.E. 2542 (1999),
Article 15 (1) (2) (3) (4) (5) and Constitution of the Thai Kingdom, B.E. 2540 (1997).
2. Violation of Labor Right Situation
Sub-committee on Labor Rights had found from its examination that there were several issues
raised in the complaints concerning many laws: namely Labor Protection Act, Social Security Act,
Compensation Fund Act, freedom of association to bargain collectively, unfair employment, short-term
employment, informal employment contract to work overseas, and migrant workers. Violations were
found from employers as well as from official executions.
There were 240 complaint cases received on human right violation between 2002 and 2007 (as at
September 30).
3. Objectives of Study
1. To compile human right violation problems on labor issue received by NHRC as from 2002 to
September 2007.
2. To publicized the result of the study in order to keep the public understand human right of
workers.
4. Scope of Study.
All cases under this study were from complaints raised by workers assigned to the sub-
committee to study and examine labor issue and 240 cases were studied between 2002 and 2007 (as at
September 30). They are divided into five groups:
1) Labor right violation on workers in private sector.
2) Labor right violation on workers in public sector.
3) Labor right violation on informal workers.
4) Labor right violation on Thai overseas workers.
5) Labor right violation on migrant workers.
5. Methodology.
1. Assessment and analysis of monitoring report on human right violation and complaint issues
between 2002-2007.
2. Compiling of concept and standard on human rights, as well as labor laws in Thailand to
accommodate labor right analysis.
3. Compiling of information from seminar and meeting with participation from concerned
agencies.
