irrelevant” to a qualification or employment related decision in particular case. Thus,
the using of “irrelevant criminal record” could constitute “discrimination”. However,
such principle has not been included in Thai related laws leading to the problems of
“stereotyping” and discrimination. Consequently, the author proposes the enactment
of Non-Discrimination Act as general human rights law or the amendment of existing
laws relating to non-discrimination in employment.
