Principle of Independence and Neutrality in the
Performance of the National Human Rights Commission of
Thailand, NHRCT*

Abstract
The discussion on this academic seminar is about the main principles of
independence and neutrality in the general sense of public officials and the principle
of independence and neutrality in the performance of the National Human Rights
Commission of Thailand, NHRCT. The principle of independence of the authorities is
normal person who are authorized to act on behalf of the state within their scope of
authority. They are free to perform their obligations under their respective jurisdiction,
which have different tasks. In order to achieve the organization’s mission, their powers
have isolated the essence of the principle of freedom in four parts:
1) to acts as the official state;
2) to complete any mission of the state;
3) to carry out their mission to achieve the missions;
4) to be bounded by the characteristics of the organization, such as
legislative bodies, judicial organization, independent organization according to the
Thai Constitution.
The independence of the organization in each dimension, such as the
independent to organize, the independent to work on function and administration
on personnel management.
For the principle of neutrality, Prof. Banjerd emphasized on the principle
of neutrality that the officials of the state must be unbiased or impartial, the conflict
in the position or incompatibility and conflict of interest.
