 ปัจเจกชนมีหน้าที่ต่อชุมชน

อารัมภบท (preamble) ของกติการะหว่างประเทศว่าด้วยสิทธิพลเมืองและสิทธิทางการเมือง

(International Covenant on Civil and Political Rights: ICCPR) และกติการะหว่างประเทศว่าด้วยสิทธิ
ทางเศรษฐกิจ สังคม และวัฒนธรรม (International Covenant on Economic, Social and Cultural

Rights: ICESCR) ได้ระบุไว้ตรงกันว่า “ปัจเจกบุคคลมีหน้าที่ต่อปัจเจกบุคคลอื่นและต่อชุมชนของตน รัฐมี
ความรับผิดชอบที่จะส่งเสริมและยอมรับสิทธิตามกติกานี้”

นอกจากนี้ ในปฏิญญาสากลว่าด้วยสิทธิมนุษยชน (Universal Declaration of Human Rights)

ข้อ 29(1) ยังได้ระบุว่า “ทุกคนมีหน้าที่ต่อชุมชนเท่าที่การพัฒนาบุคลิกภาพอย่างอิสระและเต็มที่จะเอื้อให้

กระท าได้”

จึงอาจสรุปได้ว่า ปัจเจกมีหน้าที่ต่อชุมชนตามศักยภาพของตน โดยรัฐมีหน้าที่ในการสนับสนุนปัจจัย
เพื่อเอื้อให้ปัจเจกสามารถพัฒนาตนเองและท าหน้าที่ต่อชุมชนได้

 ปัจเจกชนมีสิทธิในการนับถือศาสนาและเสรีภาพในการแสดงออกทางศาสนา

กติการะหว่างประเทศว่าด้วยสิทธิพลเมืองและสิทธิทางการเมือง (International Covenant on

Civil and Political Rights: ICCPR) ข้อ 18 1. ระบุว่า “ทุกคนมีสิทธิในเสรีภาพทางความคิด มโนธรรมและ

ศาสนา สิทธินี้รวมถึงเสรีภาพในการมีหรือนับถือศาสนา หรือมีความเชื่อตามคตินิยมของตน และเสรีภาพ

ในการแสดงออกทางศาสนา หรือความเชื่อของตนโดยการสักการบูชา การปฏิบัติ การประกอบพิธีกรรม และ
การสอน ทั้งโดยล าพังตัวเองและร่วมกับผู้อื่นในชุมชน ทั้งต่อสาธารณชนและเป็นการส่วนตัว”

นอกจากนี้ ในข้อ 27 ยังได้ก าหนดถึงสิทธิของชนกลุ่มน้อยว่า “ในรัฐซึ่งมีชนกลุ่มน้อยทางเผ่าพันธุ์

ศาสนาหรือภาษา บุคคลผู้เป็นชนกลุ่มน้อยจะไม่ถูกปฏิเสธสิทธิที่จะมีวัฒนธรรมของตนเอง หรือสิทธิที่จะนับถือ

choice, and freedom, either individually or in community with others and in public or private, to manifest his
religion or belief in worship, observance, practice and teaching.
5 International Covenant on Civil and Political Rights, Article 27 In those States in which ethnic, religious or
linguistic minorities exist, persons belonging to such minorities shall not be denied the right, in community with
the other members of their group, to enjoy their own culture, to profess and practise their own religion, or to
use their own language.
